TERMS AND CONDITIONS
1. Definitions
In this Agreement, the following terms have these meanings:
- Agreement / Rental Agreement: This agreement, including the Terms and Conditions, Particulars, and any documents incorporated by reference.
- Collection Day: The date specified in the Particulars.
- Designated Driver: The person named in the Particulars who is authorised to drive. In the case of On-Site Setup, Wee Campers NI act as the Designated Driver.
- Hirer: The person named in the Particulars hiring the Van.
- Hire Date(s): The date(s) specified in the Particulars.
- Hire Period: The duration specified in the Particulars.
- Named Guests: Any persons named in the Particulars.
- Particulars: The document titled “The Particulars.”
- Premises: 70 Railway Road, Coleraine, Northern Ireland, BT52 1PG.
- Rate: The rental price specified in the Particulars.
- Security Deposit: A deposit of 30% of full rental cost.
- Terms and Conditions: These terms and conditions.
- Van: The vehicle specified in the Particulars, selected by Wee Campers NI.
- Van Check Sheet: The checklist completed on Collection Day.
- We / Us: Wee Campers NI.
- You: The Hirer signing this Agreement.
2. Booking
2.1. Once the Rental Deposit is received, this Agreement becomes binding on both Parties.
3. Right of Refusal / Termination
3.1. We reserve the right to refuse or cancel any booking at our sole discretion, without the need to provide any explanation. This may be exercised to ensure the safety, security, and proper use of our vehicle and service, or to comply with our Terms and Conditions. We may terminate the Agreement immediately without refund or liability.
4. Accessibility
The Hirer acknowledges that the Vehicle (Bertie) is a vintage camper van and, due to its original design and age, it cannot be adapted for wheelchair users or individuals requiring accessibility modifications.
4. Cancellations and Changes
4.1. Refunds are not guaranteed if you cannot hire the Van for any reason. Deposit is non refundable.
4.2. You may request changes to the Hire Date(s) up to 2 weeks before Collection Day, subject to availability. Requests made less than 2 weeks prior will not be possible.
6. Collection, Return, and Van Check
6.1. The Van must be collected at the Premises (or other agreed location) between 2pm and 3pm on Collection Day.
6.2. Allow 30 minutes on Collection Day for briefing and completing paperwork. A Vehicle Rental Checklist confirming condition will be completed and signed by both Parties. Refusal to sign will result in forfeiture of the Rate. You must inspect and report any pre-existing damage before departure.
6.3. The Van must be returned between 10.30am and 11.30am on the final Hire Period day. Late returns without prior agreement will incur a £100 per hour fee and may also result in additional charges deducted from the Security Deposit.
6.4. If agreed, returning the Van to a different location or having it collected does not relieve you of responsibility until the Van is received by Us or recovery service.
6.5. No refunds are given for early returns.
6.6. Upon return, the Van and all equipment must be in good condition as per the Van Check Sheet.
6.7. The Van must be returned with a full fuel tank; any shortage will be charged or deducted from the Security Deposit.
7. Security Deposit
7.1. A Security Deposit of £250 is required and must be pre-authorised on a valid credit card or secured via an alternative approved payment method before or on the day of collection. This deposit is held to cover damage to the Van, its fittings or equipment, third-party claims, and any applicable insurance excess.
7.2. If the Van is not returned, is returned damaged, or requires excessive cleaning, all or part of the Security Deposit may be retained. Should the cost of damage or loss exceed the deposit amount, the Hirer will be liable for the additional costs and invoiced accordingly. We reserve the right to hold the deposit while a full assessment of any damage or charges is completed.
7.3. If the Van is returned on time, clean, undamaged, and in good condition, the Security Deposit will be released or refunded within 7 working days of the end of the hire period.
8. Hirer’s Obligations
You agree to comply with the following obligations:
8.1 Drivers’ Licence, Health and History
- One Designated Driver is included per booking. Only the Designated Driver(s) named in the Rental Agreement may drive the Van during the Hire Period.
- The Designated Driver must be between 25 and 75 years of age at the time of hire.
- The Designated Driver must be in good health and medically fit to drive. This includes not being under the influence of alcohol, illegal substances, or prescription medication that may impair driving ability.
- Drivers with declared medical conditions may drive only if the DVLA, a doctor, or GP has not imposed any driving restrictions.
- The Designated Driver must have held a full and valid driving licence for a minimum of 2 years. Accepted licences include those issued in the UK, EU, Australia, or New Zealand.
- The Designated Driver must not have had any licence suspensions or disqualifications within the past 3 years.
- The Designated Driver must have no more than one fault incident or insurance claim in the past 3 years.
- A maximum 6 points on the Designated Driver’s licence.
- The following conviction codes are disqualifying and not covered under this policy: BA (driving while disqualified), DD (dangerous driving), and UT (unauthorised taking of a vehicle).
- Convictions under the following codes are covered as standard:
– Two 3-point offences under ‘SP’, ‘TS’, or ‘CU’ codes
– One 4- or 6-point offence under ‘SP’, ‘TS’, or ‘CU’ codes - Convictions under any other codes (e.g. IN10, MS90, DR, DG, CD, etc.) are not covered.
- Drivers holding a USA, Canadian, or South African licence must have previous UK driving experience within the last 2 years.
- Additional insurance excesses apply for drivers with limited UK driving experience:
– 4+ weeks of UK experience: £2,000 additional excess
– 2–4 weeks: £3,500 additional excess
– Less than 2 weeks: not accepted - Before collection, the Designated Driver must provide a valid driving licence and two separate proofs of address, dated within 90 days. Acceptable documents include utility bills and bank statements.
- A DVLA check may be carried out. This can be completed by Wee Campers NI or by the Hirer using a check code from the DVLA website.
- The Van will not be released until all required identification and documentation has been verified and approved.
- Providing false, incomplete, or misleading information may invalidate the insurance and render the Hirer liable for all related costs, including any third-party claims.
- The Hirer warrants that all information provided is true, complete, and accurate, and that there have been no material changes (including to driving licence status or medical conditions) prior to the Hire Period.
- We reserve the right to refuse the hire of a vehicle to any driver we see fit without explanation.
8.2 Country of Hire
- Unless otherwise agreed in writing, the Van must remain within Northern Ireland for the duration of the Hire Period.
8.3 Mileage
- Mileage is limited to 50 miles per day.
- Any excess mileage must be approved in writing prior to collection and will incur a surcharge of £1 per mile.
8.4 Fuel
- The fuel level will be agreed upon at collection. The Van must be returned refilled to that same level.
- A £50 administration charge plus the cost of missing fuel will be deducted from your security deposit if the Van is returned with less fuel.
- It is your responsibility to keep the fuel tank topped up with E5 (super unleaded) petrol and to ensure the correct fuel type is used.
- The hirer will be liable for all costs associated with the removal of incorrect fuel, vehicle recovery, repairs, and any damage caused to the engine or fuel system.
- The hirer will also be liable for any loss of rental income resulting from the vehicle being out of service due to damage or necessary repairs.
- No refunds will be issued for any unused hire period due to downtime resulting from misfuelling
8.5 Good Driving Practice, Health and Safety
- You shall follow all health and safety guidelines when operating the Van and its appliances, as well as any equipment inside or attached to the Van such as the awning.
- The Designated Driver will receive a one-to-one driving lesson upon arrival, wearing appropriate footwear (no heels, platforms, wedges, or mule styles).
- The lesson includes instruction on gear changing using a diagonal gear stick pattern to avoid engine damage.
- Warning lights on the dash indicate driving problems. If any warning light appears, stop the Van immediately and safely.
- The Designated Driver must be confident in driving manual transmission vehicles.
- The vehicle is right-hand drive, with power steering. Allow ample space for braking and turning. For every 2 hours of driving, a 30-minute break is required with the engine off.
- Maximum speed is 50 mph (80 km/h). Avoid resting your foot on the clutch pedal while driving to prevent clutch burn-out.
- You acknowledge the Van’s height and accept responsibility for care when driving under low bridges or height restrictions.
- The Van must not be driven through or parked in areas with a height clearance of less than 2.2 metres. It is the Hirer's responsibility to check height restrictions before entering car parks, garages, drive-thrus, or any other areas with limited overhead clearance. Damage caused by failure to observe this restriction will be the Hirer's full responsibility.
- You may not drive through floodwater or expose the Van to salt water.
- You may not drive the vehicle on sand or any other similar non-standard road.
- You may not drive in extreme weather conditions. These are defined by: -
- Extreme weather conditions refer to any weather event that presents a significant risk to the safety of the driver, passengers, the vehicle, or other road users. This includes, but is not limited to:
- High winds (e.g., gusts exceeding 45 mph / 72 km/h) that may cause instability, particularly for high-sided vehicles such as camper vans.
- Heavy snow or ice that affects road grip and control.
- Flooding, surface water, or rising tides that could submerge or damage the vehicle.
- Storms, including thunderstorms with lightning and reduced visibility.
- Severe fog with poor visibility (typically less than 100 metres).
- Weather warnings issued by the Met Office or other official bodies, particularly amber or red warnings.
In the event of extreme weather conditions:
- The hirer must not drive the vehicle until conditions are safe and appropriate.
- The vehicle must be safely parked and remain stationary during the adverse weather event.
- If unsure, the hirer must contact Wee Campers NI for guidance and further instructions.
- Wee Campers NI reserves the right to restrict use of the vehicle or request the vehicle be returned early if extreme weather poses a risk to safety or damage to the vehicle. No refunds will be issued for any hire days lost due to weather-related driving restrictions.
- Children or pets must never be left unattended in the Van.
- Only carry passengers equal to the number of seats and ensure all passengers are securely strapped in, where seat belts are provided, and while the Van is moving.
- You are responsible for supplying and correctly using child or baby seats as per legal requirements (see ). We do not provide child seats nor accept liability for seats not supplied by us or their incorrect fitting.
- A responsible adult must always be present when appliances are in use. Gas must be turned off when the cooker stove is not in use. Appliances may only be used when the Van is off, parked on level ground, handbrake on, and in gear. Appliances must not be used while driving.
- You shall be aware of the location of safety equipment, alarms, and hazard warning lights.
- The Van must not be used to carry passengers or goods for hire or reward.
- Towing or pushing the Van or trailers is prohibited.
- The Van must not be used in any race, rally, test, or contest. You shall obey all traffic regulations and avoid restricted areas that invalidate insurance.
- The exterior of the Van must not be washed, pressure-washed, or taken through an automatic car wash under any circumstances.
- The Van must not be driven with the roof in the elevated position. Care must be taken when raising, lowering, or folding the roof to avoid damage to the roof structure and materials.
- The side steps on the Van are decorative only and are not designed to bear weight. Stepping on them is strictly prohibited. The Hirer will be held liable for any damage resulting from misuse, and no liability will be accepted for any personal injury caused by failure to comply with this instruction.
- The Designated Driver may clean the windows to ensure visibility.
- The Van is a vintage vehicle with delicate paintwork and fittings; improper cleaning methods may cause damage.
- Any damage caused by unauthorised cleaning will be treated as negligence, and the Hirer will be liable for repair costs.
- You are responsible for all road tolls, fines, and charges incurred during the Hire Period, except where those penalties can be proven to reflect upon the condition of the vehicle at the point of hire.
- In respect of any motoring offences which occur during the period of hire, such as speeding or parking infringements then the contact details of the Hirer will be passed to the appropriate fines/points issuer.
- The Van must never be overloaded or carry unsecured loads.
- The Van must not be used for illegal purposes or to carry illegal substances.
- Smoking or vaping inside the Van is prohibited. Smoking within the surrounding area of the awning is also prohibited. There will be a deduction from your security deposit should there be evidence of smoking or vaping having taken place within the vehicle upon its return to us.
- Driving under the influence of alcohol, drugs, or medication causing drowsiness is forbidden.
- The Van must be securely parked when not in use and the Steering Lock fitted.
- You are liable for any damage or breakdown caused by your actions, including engine misuse, fuel errors, clutch damage, or incorrect gear changes.
8.6 Pets
- Pets are allowed only with our prior written approval in the form of the Rental Agreement.
- We reserve the right to refuse to allow your pet(s) at our own discretion and without explanation.
- You must comply with all animal carriage laws. Pets must never be left unattended in the Van.
- Should your pet cause damage to the vehicle’s interior and/or accessories, the cost of rectification will be deducted from your security deposit in the first instance.
- Should you take a pet without prior arrangement, you will forfeit your security deposit.
8.8 Cleaning
- As part of the hire agreement you are expected to sweep out any debris in the campervan and remove all rubbish.
8.9 Keys
- You are responsible for the Van’s keys during the Hire Period. Lost or damaged keys will incur replacement and call-out charges.
8.10 Breakdown
- Notify us immediately in case of breakdown.
- The vehicle is covered by a comprehensive breakdown assistance policy. Details can be requested.
- Follow our instructions and remain with the Van until assistance arrives.
- If the Van cannot be restarted or must be returned, we will provide a Gift Voucher for the unused Hire Period.
- We do not accept liability for indirect or consequential losses from breakdowns.
8.11 Accidents, Theft, and Vandalism
- Report any accident, theft, or vandalism to the police and us immediately.
- Do not admit liability, release parties from responsibility, settle claims, or accept disclaimers as per insurance policy.
- Where possible, collect names, addresses, witness details, vehicle registrations, time, location, cause, and damage details. Take photos and video if possible.
- Do not move the Van before police arrive unless it is unsafe to leave it.
- Complete and submit an accident/theft/vandalism report form upon return, including diagrams if possible.
- Return the keys if theft occurs.
- Cooperate fully with us and insurers in investigations or legal proceedings, including providing evidence and attending court if required.
8.12 Abandonment
- The Van must be returned to the Premises at the end of the Hire Period unless otherwise agreed.
- You will be liable for all costs if the Van is not returned or is abandoned.
8.13 Your Car
- We do not accept responsibility for your car or vehicle.
9. Insurance
The Van rental includes insurance for the Designated Driver(s) authorised by us for the Hire Period.
- It is a condition of the insurance policy that the Designated Driver(s) complies with the terms of this Rental Agreement, including but not limited to the provision by the Designated Driver(s) of identification information.
- You shall provide true and complete information for our insurers as requested at the time of booking.
- You are advised to take out your own personal effects and travel insurance to cover items not part of the insurance, last-minute cancellations, etc.
- In the event of a claim for which you are liable under this Rental Agreement which results in a claim being made against the Van’s insurance policy, you shall be liable to pay any insurance excess applicable in respect of each claim.
- Comprehensive Self Drive Hire Insurance cover through Allianz is included in the rental price, with a standard excess of £750 payable in the event of any accident damage to either the vehicle or third-party property. The Hirer will be liable for this excess.
- Repair costs which are less than the insurance standard excess will be invoiced directly to the Hirer.
- The Hirer should request the Self Drive Hire Policy wording for further information.
10. Charges
10.1 The amounts stated in the Particulars reflect your specific rental agreement of the Van during the Hire Period and include basic hire charges, insurance, and charges for any optional or ancillary services chosen by you, and any applicable taxes at the prevailing rate. Additional charges which may arise from your use of the Van during the Hire Period or in any event until the Van is returned to the Premises and/or us shall be payable by you and may include (but are not limited to) loss of or damage to the Van and its contents, the insurance excess, additional cleaning costs, refuelling service charge and fuel cost, any late return charge, excess mileage charges, any additional driver charge, any pet damage charge, misfuelling charges, and any unpaid road tolls or fines or charges arising from traffic or parking offences.
All charges and expenses payable by you under this Agreement are due on demand by us. If you do not pay all charges due, a late charge of 5% per calendar month on the outstanding balance and any collection costs incurred by Wee Campers NI, including reasonable legal fees, will be added.
11. Credit Card Authorisation
Where payment is made by you via credit card, you agree that we are irrevocably authorised to complete any documentation and recover all amounts due pursuant to this Rental Agreement in respect of the Security Deposit, the Rate, any additional charges, and/or cost and/or loss as set out in this Rental Agreement.
12. The Extent of Your Liability
12.1 You are aware that we shall rely and/or be deemed to have relied upon the information you have provided us, and you are aware that the validity of the Van’s insurance is based on your compliance with the terms and conditions of this Rental Agreement.
12.2 You shall be liable for and indemnify us against all claims, losses, costs, charges, liabilities, and expenses suffered or incurred by us arising out of or in connection with any act, error, omission, default, negligent act or misstatement, wilful misconduct, delay, illegal act, or failure caused by you and/or others under your care, or in connection with your actions under this Agreement. Your indemnity under this clause remains in force for the duration of this Rental Agreement and continues to survive expiry or termination of this Agreement, together with any other clauses or schedules necessary to give effect to it.
13. Personal Injury Disclaimer
• The Hirer and any passengers use the Van entirely at their own risk.
• Wee Campers NI shall not be held liable for any personal injury, loss, or damage sustained by the Hirer or any third party during the Hire Period, except where such injury, loss, or damage arises directly from our proven negligence.
• The Van is a vintage vehicle, and while maintained to a high standard, it may not include modern safety features. The Hirer accepts full responsibility for ensuring their own and their passengers' safety throughout the Hire Period.
• The Hirer is responsible for ensuring safe use of all fixtures, fittings, and equipment within the Van and must exercise caution when entering, exiting, and moving around the vehicle.
• Any personal injury resulting from misuse, failure to follow safety instructions, or disregard for warnings (including but not limited to improper use of the roof or side steps) shall be the sole responsibility of the Hirer.
• By signing the Rental Agreement, the Hirer confirms their understanding and acceptance of these terms and waives any right to pursue a personal injury claim against Wee Campers NI, except in cases of gross negligence
14. Entire Agreement Clause
This Rental Agreement overrides and supersedes all previous correspondence and any previous course of dealings between us.
- In the event of any inconsistency between these Terms and Conditions and any other of our literature, whether found on our website or otherwise, the provisions of these Terms and Conditions will prevail.
- If any provision of these Terms and Conditions is prohibited by law or judged by a court to be unlawful, void, or unenforceable, the provision shall, to the extent required, be severed from this Agreement and rendered ineffective as far as possible without modifying the remaining provisions of this Agreement, and shall not in any way affect any other circumstances of or the validity or enforcement of these Terms and Conditions.
14. Your Personal Data
When you book a Van, we collect personal information such as your name, email address, home address, telephone number, credit or debit card number, security code, and the card’s expiry date. This allows us to book the Van and insurance for you.
In addition, our vehicle is fitted with a GPS tracking device. This allows us to monitor the location, movement, and status of the vehicle at all times.
The tracking system is used strictly for the purposes of:
- Ensuring the safety and security of the vehicle
- Assisting in the event of theft, breakdown, or accident
- Monitoring mileage, speed, and adherence to restricted zones
- Ensuring compliance with our Terms & Conditions
- The tracking system may collect the following data during your hire period:
- Real-time and historical location
- Vehicle speed and movement patterns
- Start and end times of journeys
- You give us permission to use this information that we collect to occasionally notify you about news and information we think you may find valuable. For example, we may send you newsletters and special offers. If at any stage you decide that you no longer wish to receive such information, please contact us by telephone, email, or post.
- We reveal your identity information to our insurance company and you authorise us to do so. We will not sell your information to another company.
15. Governing Law and Jurisdiction
This Rental Agreement and any dispute or claim arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the laws of Northern Ireland.
We both irrevocably agree that the Courts of Northern Ireland shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Agreement or its subject matter.
